Terms and Conditions
SCOPE OF WORK
Concept 360 Interiors Limited provides the following interior design services to the client.
- Space planning and layout design
- Selection and procurement of furniture, fixtures and finishes
- Lighting design
- Colour consultation
- Kitchen and bathroom design
- Custom cabinetry design
- Art and accessory selection
- Design presentations and rendering
- Documents and specifications
- Budget management and cost estimating
- Post-construction styling and detailing
ESTIMATES
- Quotes provided by Concept 360 interiors are open for acceptance for a period of thirty days, after which the quote may be withdrawn or revised without notice to the client.
- If a client wishes to accept our quote, they must do so by signing the Concept 360 Interiors quotation relevant to their project and making the deposit payment.
- By accepting the quotation, the client agrees to these Terms and Conditions of Business.
- Any additional works are to be agreed in writing. This is to be agreed between the client and Concept 360 Interiors Limited before any additional works commence.
INTELLECTUAL PROPERTY
- Any designs, specifications and/or illustrations prepared by Concept 360 Interiors always remain their intellectual property and must not be duplicated, copied or otherwise used without expressed written consent by Concept 360 Interiors Limited.
- If designs, specifications and/or illustrations are duplicated, copied or otherwise used by the client or their agent(s) without our expressed written consent, Concept 360 Interiors reserve the right to:
- Charge the client for time spent in preparing such designs, specifications and/or illustrations.
- Initiate proceedings for breach of intellectual property rights.
PAYMENT
- We require a deposit payment to be made, representing 50% of the quote for the materials to be supplied to the client before they are ordered. A further payment, representing the remaining balance of the quote for the materials to be supplied to the client, must be made upon the materials arriving in Guernsey, prior to delivery to site or collection by the client or their agent(s).
- Interest will be added to any overdue payments, which is to accrue on a weekly basis at the rate of 3%. Neither disagreement arising under this contract, or factors outside of the client’s control, shall entitle the client to delay payment of monies owed to us in full or in part.
- Any materials supplied by Concept 360 Interiors Limited remains in the legal ownership of Concept 360 Interiors Limited, until payment in full has been received in accordance with clause 7.
- Up to three design revisions are included as part of the agreed scope of works unless otherwise advised. Any additional revisions requested beyond this limit will be subject to an additional charge of £70 per hour.
LIMITATION OF LIABILITY
- All materials that are ordered are transmitted to us via road and by sea. Both the carriers we use are insured against loss arising from carriage of goods.
- We are not liable for any loss of profits, distress, inconvenience, loss of use or other consequential loss as a result of breach of contract, duty or any other default by us and/or our agent(s), unless determined by arbitration or a court under the governing laws of the Bailiwick of Guernsey.
- Notwithstanding any relevant prescription period prescribed by law, any claim against Concept 360 Interiors Limited must be commenced within twelve months of any cause of action, or otherwise be time-barred.
- Concept 360 Interiors Limited are not liable for any loss arising from the use of our designs, specifications and/or illustrations by any party other than Concept 360 Interiors Limited, unless we have expressed written consent for that party to use such designs, specifications and/or illustrations.
- Concept 360 Interiors Limited are not liable for any delays in the manufacturing or delivery process. All dates we provide to the client are estimates given in good faith. They do not constitute terms, conditions, warranties or representations of the contract between us.
- Concept 360 Interiors are not liable for any loss arising from a force majeure, including but not limited to war, strike, embargo, government requirement, civil or military authority, act of nature or the public enemy, or act or omission of carriers.
- It is the client’s responsibility to provide us with clear instructions as to their requirements.
- A 25% restocking fee will be charged against the value of the goods of any items returned to Concept 360 Interiors after ordering. This policy also applies to items altered or changed after final approval, particularly when returns to the manufacturer are no longer possible.
- Concept 360 Interiors Limited will not accept the return of unboxed or damaged goods and returns will be time barred to 24 hours post-delivery to site.
- The Client is responsible for inspecting all items immediately upon delivery to their premises. Any damages or defects must be reported to Concept 360 Interiors in writing within 48 hours of delivery with any images detailing the damage. Failure to report within this timeframe will result in the Client being fully liable for the cost of any replacements.
- Concept 360 Interiors shall not be held liable for any damage discovered after the delivery or fitting of goods. All goods are thoroughly inspected upon receipt by Concept 360 Interiors and again prior to dispatch.
CHOICE OF LAW AND ARBITRATION
- This contract is governed by and is construed in accordance with the laws of the Bailiwick of Guernsey.
- Any disputes arising out of or in connection with this agreement will be resolved through mediation or arbitration, as agreed upon by the parties.
- Each paragraph, term or provision of these Terms and Conditions of Business constitutes an independent provision. If any paragraph, term or provision is determined by any court or authority to have competent jurisdiction to be void, illegal or unenforceable, the remaining paragraphs, terms and provisions will continue in full force and effect.
- Concept 360 Interiors Limited abide by the Data Protection (Bailiwick of Guernsey) Law 2017 in carrying out all of its business operations and handling of clients information.
STORAGE AND INSTALLATION
- We reserve the right to delay an installation if the site is not ready according to the checklist provided on acceptance of quote. Should the client wish to proceed it will be at Concept 360 Interiors Limited will safely store kitchens for a period of 4 weeks from date of arrival, should the site not be ready for installation. There following a weekly storage fee of £200 per week, payable monthly in arrears will be invoiced.
WARRANTIES AND INDEMNIFICATION
- Concept 360 Interiors Limited warrants that all services will be performed in a professional and workmanlike manner. If the client suffers any losses or damages as a result of our Concept 360 Limited ‘s actions or omissions, our company will indemnify the client for such losses or damages.
- Warranty details are available on request and supplier specific so product to product there is variance.
TERMINATION
- Either party may terminate this agreement at any time upon written notice to the other party. In the event of termination, Concept 360 Interiors Limited will be entitled to payment for any work completed up to the date of termination. Any deposit will be returned to the client, minus any costs incurred by our company.
ENTIRE AGREEMENT
- This agreement constitutes the entire understanding between the parties and supersedes any prior agreements or understandings.
Please note
- Any changes or additions to the scope of work must be requested in writing and will be subject to additional fees. The client will be notified of any such fees before work on the changes or additions begins. Any work must be signed off by the client.
- Please review the designs thoroughly to ensure all items are correct and accounted for. Whilst we do our best to interpret your designs & specifications accurately, we may not always interpret them in the same way. Please ensure the specification is correct with your chosen purchases before confirmation of orders.
